Marketing a Property Legally
Under the Energy Performance of Buildings (England and Wales) Regulations 2012, an EPC must be commissioned before a property is put on the market, and the agent must use reasonable efforts to obtain it within 7 days. The energy rating must appear in every advertisement. Marketing without a valid EPC exposes the agent, not only the seller, to a penalty of £200 per property. For lettings, the property must also reach at least EPC Band E (rising to Band C in 2028), hold a valid EICR renewed every 5 years, and an annual Gas Safety Certificate where gas appliances are present. HMO instructions additionally require a Fire Risk Assessment reviewed annually.
